A Slow Start, Then a Major Turnaround

Sabalenka began the match strongly and looked in control after taking the opening set 6-2. The Belarusian also moved ahead early in the second set, but Cîrstea gradually found her rhythm and started to turn the match into a physical and mental battle.

The Romanian became more aggressive from the baseline, reduced her errors and forced Sabalenka into longer exchanges. From that point, the momentum shifted. Cîrstea took the second set 6-3 and pushed the match into a decider.

The third set delivered the tension expected from a match against the top seed. Sabalenka fought to stay alive and levelled the score at 5-5, but Cîrstea remained composed in the decisive moments.

Simona was invited to the Miami Open following a drastic reduction of the initial 4-year suspension ban. Organizers offered her a wild card; her first match was against the Spanish Paula Badosa on Tuesday, March 19.

Simona Halep raced through the first set and seemed in excellent shape. Yet, those 19 months of her off the tennis court hindered her from maintaining that level, and she lost 1-6 6-4 6-3.

Basically, Simona Halep’s suspension was reduced from four years to nine months, starting from October 7, 2022, which means Simona can get back to playing tennis again.

The appeal procedures before the CAS concerned two separate charges

1. a charge which arose from a prohibited substance (Roxadustat) being detected in a urine sample collected from Simona Halep on 29 August 2022 during the US Open; and

2. a charge that Ms Halep’s Athlete Biological Passport (ABP), particularly a blood sample given by Ms. Halep on 22 September 2022, established the use of a prohibited substance and/or method.

In its decision dated 22 September 2023, the International Tennis Federation (ITF) Independent Tribunal found Ms Halep guilty of both Anti-doping Rule Violations (ADRV) and imposed four years of ineligibility on her.

In the appeal filed by Simona Halep at the CAS against the first instance decision, Ms. Halep requested that the sanction be reduced and be no longer than the period of the provisional suspension already served. In its separate appeal, the ITIA requested that the CAS sanction Ms Halep’s ADRVs together as one single violation based on the violation that carried the most severe sanction and the imposition of a period of ineligibility of four to six years.

The CAS appeal arbitration proceedings involved intensive pre-hearing processes and a three-day hearing on 7-9 February 2024 in Lausanne, Switzerland. The CAS Panel heard from many lay and expert witnesses, most of whom were present in person at the hearing.

The CAS Panel has unanimously determined that the four-year period of ineligibility imposed by the ITF Independent Tribunal is to be reduced to a period of ineligibility of nine (9) months starting on 7 October 2022, which period expired on 6 July 2023.

As that period expired before the appeal procedures were even lodged with the CAS, the CAS Panel has determined it appropriate to issue the operative part of the Arbitral Award as soon as practicable, together with a comprehensive media release.

The CAS Panel has also ordered the disqualification of all competitive results achieved by Ms. Halep from 29 August 2022 (the date of her positive sample) to 7 October 2022, including forfeiture of any medals, titles, ranking points and prize money. Therefore, the appeal filed by the ITIA is dismissed, and the appeal filed by Simona Halep is partially upheld (her request to backdate the start of the suspension on 29 August 2022 is dismissed).

Simona Halep’s Roxadustat Charge

According to Articles 2.1 and 2.2 of the Tennis Anti-Doping Programme (“TADP”), each player must ensure that no prohibited substance enters their body, and players are responsible for any prohibited substances found in their samples. A prohibited substance (i.e. Roxadustat) was present in a sample collected from Ms. Halep on 29 August 2022 during the US Open.

Ms. Halep did not contest liability in that she accepted that, because of the presence of Roxadustat in her sample, she had committed anti-doping rule violations under Articles 2.1 and 2.2 of the TADP. However, she objected to the intentional nature of the infraction and argued that the positive test resulted from contamination.

Having carefully considered all the evidence put before it, the CAS Panel determined that Ms. Halep had established, on the balance of probabilities, that the Roxadustat entered her body through the consumption of a contaminated supplement which she had used in the days shortly before 29 August 2022 and that the Roxadustat, as detected in her sample, came from that contaminated product.

As a result, the CAS Panel determined that Ms. Halep had also established, on the balance of probabilities, that her anti-doping rule violations were not intentional.

Although the CAS Panel found that Ms. Halep did bear some level of fault or negligence for her violations, as she did not exercise sufficient care when using the Keto MCT supplement, she bore no significant fault or negligence.

Athlete Biological Passport (ABP) Charge

Concerning the charge concerning Ms. Halep’s ABP, the ITIA bore the onus of establishing (to the standard of comfortable satisfaction) that Ms. Halep had used a prohibited substance and/or prohibited method. It primarily relied on a blood sample given by Ms. Halep on 22 September 2022, the results of which it alleged demonstrated the anti-doping rule violation under Article 2.2 of the TADP.

Contrary to the reasoning of the first instance tribunal, the CAS Panel determined that it was appropriate to consider the results of a private blood sample given by Ms. Halep on 9 September 2022 in the context of a surgery which occurred shortly after that.

Those results, and Ms. Halep’s public statements that she did not intend to compete for the remainder of the 2022 calendar year, impacted the plausibility of the doping scenarios relied upon by the ITF Independent Tribunal. Regarding the evidence, the CAS Panel was not comfortably satisfied that an anti-doping rule violation under Article 2.2. of the TADP had occurred. It, therefore, dismissed that charge.

Court Orders Regarding Simona Halep’s Doping Case

The CAS Panel has issued the following decision:

1. The appeal filed by Simona Halep on 28 September 2023 against the decision issued on 22 September 2023 by the ITF Independent Tribunal is admissible and is partially upheld.

2. The appeal filed by the International Tennis Integrity Agency (ITIA) on 14 December 2023 against the decision issued on 22 September 2023 by the ITF Independent Tribunal is admissible and is dismissed.

3. The decision issued on 22 September 2023 by the ITF Independent Tribunal is set aside.

4. Simona Halep is found to have committed Anti-Doping Rule Violations under Articles 2.1 (presence) and 2.2 (use) of the Tennis Anti-Doping Programme 2022 as a result of the presence of a Prohibited Substance (Roxadustat) in her urine sample collected In-Competition on 29 August 2022.

5. Simona Halep is sanctioned with a period of Ineligibility of nine (9) months, commencing on 7 October 2022.

6. Credit is given to Simona Halep for her provisional suspension served since 7 October 2022.

7. All results obtained by Simona Halep in competitions from 29 August 2022 to 7 October 2022 are disqualified, with all resulting consequences, including forfeiture of any medals, titles, ranking points and prize money.

8. The award is pronounced without costs, except for the Court Office fees of CHF 1,000 (one thousand Swiss francs) paid by each of Simona Halep in respect of her appeal and the International Tennis Integrity Agency (ITIA) in respect of its appeal, which the CAS retains.

9. The International Tennis Integrity Agency (ITIA) is ordered to pay Simona Halep an amount of CHF 20,000 (twenty thousand Swiss francs) as a contribution towards her legal fees and other expenses incurred in connection with these arbitration proceedings.

The play-off between Romania and Serbia was in Kraljevo, Serbia, but the home team didn’t take advantage of playing in front of their fans. It was 0-2 after the first day, and the following matches haven’t made any difference.

After the two victories on Friday (achieved by Gabriela Ruse, 2-0, with Mia Ristic and Jaqueline Cristian, 2-0, with Aleksandra Krunic) and the success on Saturday (achieved by Jaqueline Cristian, 2-1, in front of Lolei Radivojevic), the “doubles” team of Romania, consisting of the pair Monica Niculescu (944 WTA) and Anca Todoni (250 WTA), won against the couple Katarina Kozarov / Aleksandra Krunic with a score of 2-0 (6-1, 7-6).

Romania and all the other winning nation teams will compete in the Billie Jean King Cup Qualifiers in 2024, with a chance to qualify for next year’s Finals.

In April this year, Romania lost 2-3 at home with Slovenia in the Billie Jean King Cup after having 2-0 on the first day, thus losing the opportunity to go further in the competition to the final tournament.

I feel confident for the future of Simona with her appeal to the CAS because it’s an independent tribunal. We have been able to establish where the contamination comes from. So we proposed her to take collagen, and we brought her collagen from a company. This collagen happened to be contaminated. There is no way to know it, but I feel responsible for what happened because it’s my team, so me basically, who brought her this collagen

We have done all possible tests to establish that we are talking about contamination. I’m very confident that this independent tribunal will recognize the fact that she never did doping, she is a victim, and she has to come back to the court and be able to compete as soon as possible.

It opened my eyes on the fact that any athlete can become contaminated tomorrow because apparently, this happens more and more. Products (which) are supposed to be clean, happen to be contaminated. We’re talking about extremely low levels of something. When I say extremely low, it’s extremely low, so it has zero effect. But, it happens you have in your system something that shouldn’t be there that makes you positive to an anti-doping test. And this is terrible because you are completely innocent, your reputation is impacted, hurt by the fact that your name has to do with doping even though you didn’t do any doping. Your career is stopped for a period of time that is extremely long. It can affect your whole career, it affects your reputation for a very unfair reason because you have done nothing.

So it opened my eyes that it can happen to anyone, and the companies that you decide to go with for supplements, you have to be sure at 100% that this cannot happen.

Patrick Mouratoglou taking responsibility for Simona Halep’s doping scandal in an Instagram post

Patrick Mouratoglou was Simona’s coach at the time the scandal occurred and he had been working with Simona for 6 months. Rumour has it Mouratoglou is also the reason for which Simona and her former husband chose to divorce, but this is just a rumour that the tabloid local media in Romania published at that time, never confirmed by either of the parties.

Simona Halep was suspended in October 2022 by the WTA following a positive test during the American Open. In September this year, the International Tennis Integrity Agency (ITIA) announced that former Wimbledon and French Open winner Simona Halep was handed a four-year suspension following two anti-doping rule breaches.

Mouratoglou’s statements come a little bit too late, as some say. His admission of the guilt might not be able to help Simona during her appeal, but at least could clean Simona’s reputation.

Simona Halep is currently waiting for a decision from TAS-CAS, the sports tribunal which is the last court to judge the case. If the decision at TAS is favourable, Simona could play again in the WTA after a one-year unfair suspension.

Gabriela Ruse had qualified for the Transylvania Open final after a superb victory over the tournament’s fourth seed, Rebeka Masarova. Gabriela defeated Masarova 6-1, 6-4, securing her spot in her third WTA career final, following those in Hamburg and Palermo, both played in 2021.

Tamara Korpatsch became the first player to qualify for the Transylvania Open 2023 final after a swift victory over Eva Lys, this edition’s surprise. Korpatsch defeated Lys 6-4, 6-3, in her most apparent victory in Cluj this week.

Gabriela Ruse, helped by fantastic attendance support, started better than the German and had 3-0. Afterwards, the German player started winning valuable points, taking advantage of Gabriela’s medical condition and her double faults and unforced errors. The game had to be stopped for medical time-outs, as Gabriela needed medical assistance for muscle contraction in her left calf.

Gabriela Ruse suffered from her injury throughout the game, drastically impacting her performance. Even though she seemed to recover in the second set, she couldn’t do more after a sensational week in Cluj.

Gabriela is the second Romanian who reached the Transylvania Open Tournament final after Simona Halep in 2021. The latter lost to Annet Kontaveit in two sets.

On Tuesday, the International Tennis Integrity Agency (ITIA) announced that former Wimbledon and French Open winner Simona Halep was handed a four-year suspension following two anti-doping rule breaches. Halep, 31, was provisionally suspended in October 2022 after testing positive for Roxadustat at the US Open the previous year.

A second doping charge was lodged against her in May because of discrepancies in her athlete’s biological passport. The ITIA stated that this charge was separate from her 2022 provisional suspension. These biological passports serve as a standard record of substances in an athlete’s system and are used as a tool against doping.

It is of the utmost importance for players to be aware of the Tennis Anti-Doping Program rules and to follow them.  The Independent Tribunal has ruled surrounding Simona’s case, and under the TADP, the decision may be appealed to the Court of Arbitration for Sport. The WTA will support the decisions reached through the process and continue to follow this closely.

I continue training and am committed to removing my name from these allegations. I intend to appeal this decision to The Court of Arbitration for Sport and seek legal action against the supplement company involved.

Before her, in 2022, Sorana Cirstea and Irina Begu, other valuable players, decided to refuse to represent Romania in Billie Jean Cup any longer.

Sorana is currently being sponsored by New Balance, after having a long 10-year sponsorship contract with Adidas, between 2006 to 2016. The tennis player made this decision after learning that the sports giant was more focused on the athletes’ appearances than their on-field performance.

Unfortunately, she is not the only professional Romanian athlete that faced problems with the contracts and partnerships with the Adidas brand. Simona Halep, the top tennis player worldwide, also contracted with Adidas from 2014 to 2018. The athlete was under-payed by the sponsor for her outstanding performances and wanted to receive more, however, Adidas refused. This was a big loss for the brand, given that shortly after, the athlete signed a $1.7 million contract with Nike.

The International Tennis Integrity Agency (ITIA) announced that Simona Halep tested positive for Roxadustat, a banned substance listed in the 2022 World Anti-Doping Agency (WADA) Prohibited List.

She or her coach Patrick Mouratoglou didn’t expect her poor performance by that time, as Simona was knocked out of the first round of this year’s US Open in August, losing to world No. 124 Daria Snigur.

In a statement on social media, the Romanian tennis player says she will fight to prove her innocence.

Today begins the hardest match of my life: a fight for the truth. I have been notified that I have tested positive for a substance called Roxadustat in an extremely low quantity, which came as the biggest shock of my life. Throughout my whole career, the idea of cheating never even crossed my mind once, as it is totally against all the values I have been educated with. Facing such an unfair situation, I feel completely confused and betrayed. I will fight until the end to prove that I have never knowingly took any prohibited substance and I have faith that sooner or later, the truth will come out.

Two ideas immediately pop out besides the idea of her innocence: she says she feels “betrayed,” which implies an accusation against her staff, and she also mentioned she had never knowingly taken any prohibited substance.

Interestingly, Simona’s coach Patrick Mouratoglou hasn’t yet discussed this subject on social media or elsewhere publicly.

Doping and Romanian athletes

It is not the first time Romanian athletes have been suspended or investigated for doping-related accusations. Famous or less famous, there are tens of athletes investigated after testing positive for forbidden substances.

Andreea Raducan, the gymnast lost her all-around title at the 2000 Olympics after testing positive for pseudoephedrine. She said the substance was in the composition of some medicine for colds, and her staff was administering her.

Adrian Mutu, the football player, tested positive for forbidden substances in 2010 after a match in Copa d’Italia. She served a ban for 9 months. In 2004, he was suspended while playing for Chelsea after testing positive for cocaine.

Elena Fidatov, the middle and long-distance runner who competed for Romania in the early 90s, received a ban in 1998.

Violeta Szekely (born Violeta Beclea), famous for winning the 1,500-meter race at the 2000 Summer Olympics, received a four-year ban for testing positive for prohibited substances in 1995.

The list goes on, but these are just some Romanian athletes testing positive during their careers.
