<p class="wp-block-paragraph">In a landmark ruling delivered on 24 April 2025, the<em> Ploiești Court of Appeal provisionally suspended and ultimately annulled the December 2024 decision of Romania’s Constitutional Court (CCR)</em>, which had voided the results of the first round of last year’s presidential election. The order, handed down by Judge Alexandru Vasile, throws the upcoming second round—scheduled for 29 April 2025—into legal uncertainty and will itself be subject to appeal at the High Court of Cassation and Justice (ÎCCJ).</p>



<p class="wp-block-paragraph">On 6 December 2024, the <a href="https://valahia.news/constitutional-court-cancels-elections/">CCR issued Decision No. 32, declaring the 24 November 2024 first-round vote invalid</a>, citing systemic procedural irregularities uncovered in declassified security documents alleging foreign-state interference in favour of <a href="https://valahia.news/who-is-calin-georgescu/">Calin Georgescu</a>, the nationalist candidate. </p>



<p class="wp-block-paragraph">That verdict—final and unappealable under Romania’s Fundamental Law—prompted plans for a repeat presidential contest in spring 2025. Additionally, the decision initiated the <a href="https://valahia.news/calin-georgescu-accusations/">investigation procedures against Calin Georgescu</a>.</p>



<h3 class="wp-block-heading">The Ploiești Court of Appeal’s Decision</h3>



<p class="wp-block-paragraph">Acting on a contentious administrative lawsuit (Case No. 301/42/2025), Judge Vasile granted the plaintiff’s request to suspend execution of the CCR’s annulment ruling and subsequently declared that ruling null and void. The judgment orders the CCR to cover the court stamp tax of 70 lei. However, under statutory procedure, the CCR has five days to file a recourse with the ÎCCJ.</p>



<h3 class="wp-block-heading">Immediate Reactions and Appeals</h3>



<ul class="wp-block-list"><li><strong>Constitutional Court &amp; Prosecutor’s Office:</strong> Both the CCR and the Ploiești Prosecutor’s Office have already lodged appeals against the Ploiești verdict, seeking its reversal at the ÎCCJ.</li><li><strong>Central Electoral Bureau (BEC):</strong> The BEC has maintained that the Ploiești ruling has “no practical effect,” emphasizing that its December 2024 decision confirming the vote invalidation—and subsequent government orders based on it—remain presumptively legal and binding.</li><li><strong>Consiliul Superior al Magistraturii (CSM):</strong> In light of the intense public interest, the CSM’s Judges’ Section has referred Judge Vasile to the Judicial Inspection for a disciplinary probe, noting that in nearly 30 identical challenges nationwide, appeal courts uniformly dismissed such actions.</li></ul>



<p class="wp-block-paragraph">Former CCR President Augustin Zegrean condemned the Ploiești decision as “untenable,” underscoring that Constitutional Court judgments are “generally binding upon publication in the Official Gazette” and expressly immune from judicial review by any ordinary court. He warned that, should the ruling stand, it would automatically nullify the scheduled April 29 runoff, recreating a legal vacuum over the entire electoral process.</p>



<h3 class="wp-block-heading">Implications for the Electoral Calendar</h3>



<p class="wp-block-paragraph">With the second round days away, the Ploiești decision threatens to paralyse the campaign and voting procedures. International partners and election observers are expected to await the ÎCCJ’s definitive ruling before acknowledging any presidential victor. Until then, candidates may continue campaigning, though the legality of polling stations, ballot printing and voter mobilisation remains in limbo.</p>



<p class="wp-block-paragraph">The ÎCCJ will have the final say on whether a court of appeal can override a Constitutional Court decision. Its forthcoming judgment will either reaffirm the CCR’s exclusive constitutional authority or, for the first time, validate an appellate court’s power to annul a constitutionally binding act—thereby setting a profound precedent for Romania’s separation of powers and constitutional jurisprudence.</p>

<p class="wp-block-paragraph"><em>Update</em>: The judge decided that the brothers should be released. The decision is final. The reason is that the two are investigated in Romania in a different criminal file. Thus, the extradition procedure is postponed until the Romanian justice finishes their trial and the case in Romania is closed.</p>



<p class="wp-block-paragraph"><em>initial news</em>: The Tate brothers were arrested again on Monday, March 11, evening by authorities in Romania in connection with new charges from a criminal file in the UK. Andrew and Tristan Tate are in the custody of the Romanian Police and are to appear in front of a judge who will decide their extradition to the United Kingdom.</p>



<p class="wp-block-paragraph">According to information from sources, these accusations refer to facts of a sexual nature in a file of the prosecutors from Great Britain. </p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>On March 11 of this year, around 23:15, the police officers of the Criminal Investigation Service, of the Special Actions Service and local police officers implemented two European arrest warrants, issued by the judicial authorities in Great Britain, for the commission of sexual crimes, exploitation of persons on the territory of Great Britain.</p><cite>Romanian Police on Tate brothers being arrested again</cite></blockquote>



<p class="wp-block-paragraph">Allegedly, four women had filed a civil action against the brothers, the alleged crimes being committed between 2013 and 2016 when the brothers were still living in the UK. The complaints mention bodily injury and psychological damage caused by the alleged violent sexual and physical assaults, as well as coercive control. </p>



<p class="wp-block-paragraph">The two men were presented to the prosecutor from the Prosecutor&#8217;s Office attached to the Bucharest Court of Appeal, who ordered the detention measure for 24 hours. </p>



<p class="wp-block-paragraph">The Tate brothers were arrested in December 2022 and spent three months in police custody and under arrest.</p>



<p class="wp-block-paragraph">In March last year, <a href="https://valahia.news/tate-brothers-free-march-31/">the court decided to replace the measure of preventive arrest for the Tate brothers </a>and for the two accomplices, Georgiana Naghel and former police officer Alexandra-Luana Radu, with house arrest for 30 days, from 31.03.2023, until 29.04.2023, inclusive.</p>

<p class="wp-block-paragraph">The Romanian Opposition party USR announced they would file an official complaint at the Anti-corruption Department. In their opinion, the Government manipulated the stock market in the Rosia Montana Gold Corporation case. </p>



<p class="wp-block-paragraph">After <a href="https://valahia.news/romania-wins-process-rosia-montana-gold-corporation/">Romania won the case against Gabriel Resources</a>, questions were asked: why did the Romanian Government officials let the general public know they expected Romania to lose the case? </p>



<p class="wp-block-paragraph">A month before the decision of the Arbitrary Court was announced, Romanian Government officials offered interviews to journalists, letting the public understand that Romania was expected to lose the case and to pay billions in compensation. </p>



<h2 class="wp-block-heading">Statements and news saying Romania would lose the case against Gabriel Resources a month before the decision was taken</h2>



<p class="wp-block-paragraph">Romanian TV stations, such as <a href="https://www.digi24.ro/stiri/actualitate/justitie/surse-romania-pierde-procesul-cu-gabriel-resources-pentru-rosia-montana-ar-trebui-sa-platim-cel-putin-2-miliarde-de-dolari-2670795">Digi24</a>, cited &#8220;sources&#8221; who let journalists know that the officials expected Romania to lose the case.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Romania expects that on February 10, it will lose the lawsuit brought by Gabriel Resources to our country for the gold from Roșia Montană after the scandal by which the location was included in the UNESCO Heritage. Government sources stated that the subject was discussed on Wednesday in the Government meeting, Marcel Ciolacu and the Minister of Finance expecting that Romania will be obliged to pay at least two billion dollars.</p><cite>Romanian natinoal TV station Digi24 on January 31, 2024</cite></blockquote>



<p class="wp-block-paragraph">This information was confirmed by how the Prime Minister referred to the case in February.</p>

<p class="wp-block-paragraph">The Minister of Finance, Marcel Bolos, took the same approach and referred to the case similarly.</p>

We have carefully analyzed the expenses already carried out in Roşia Montană, and indeed, any decision of this kind puts pressure on the state budget. The calculations show that expenses of around one billion euros have been made. So we expect a decision if given in this regard, that provides compensation at this level of the already invested amount. <p class="wp-block-paragraph">Such statements had the role of manipulating the stock market, in Catalin Drula&#8217;s opinion. The Leader of the Save Romania Union Party &#8211; USR announced official complaints against the two officials. </p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>We will file a criminal complaint with the Anti-corruption Department. For the manipulation of the capital market and the undermining of the national economy, I told you that we would also notify the regulator of the capital market in Ontario, Canada, where Gabriel Resources, the company behind the Roşia Montană project, is listed because the manipulation of the capital market means that some people are having their money stolen based on false statements. Practically, in a single month, based on the irresponsible statements of Marcel Ciolacu, Marcel Boloş and their party colleagues, the value of the shares doubled. The Canadian company now has a market capitalization of over 800 million Canadian dollars, representing over 600 million dollars. <p class="wp-block-paragraph">According to USR, Cătălin Drula, the leader of the USR, warned from February 1 &#8220;that the irresponsible statements&#8221; of Prime Minister Marcel Ciolacu and the ministers &#8220;do nothing but enrich their smart boys on the stock market.&#8221;</p>



<h2 class="wp-block-heading">Why publicly say you expect to lose a case a month before the decision?</h2>



<p class="wp-block-paragraph">Beyond any stock market manipulation scenario, which the anti-corruption and regulatory authorities must investigate, another detail is not mentioned. <em><strong>There is an unwritten rule that you don&#8217;t make such statements before any decision</strong></em>. If you, a government official, show that you expect to lose a case, chances are you will encourage such a decision from those who are supposed to be unbiased, especially in such complex cases. This might have led to a catastrophic scenario.</p>



<p class="wp-block-paragraph">According to estimates from Gabriel Resources, the Canadian mining company that has sought to develop the Rosia Montana project since the late 1990s, the site holds approximately 314 tons of gold and 1,500 tons of silver. This vast treasure, buried beneath the mountain’s verdant slopes, is valued at tens of billions of dollars, fluctuating with the volatile prices of precious metals on the global market.</p>



<p class="wp-block-paragraph"><a href="https://valahia.news/how-much-gold-rosia-montana/">The value of gold in Rosia Montana today amounts to almost 19 billion euros</a>, adding more than one billion euros for silver.</p>

<p class="wp-block-paragraph">On Tuesday, February 20, 2024, Romanian prosecutors and police officers brought back to the country <a href="https://visitbucharest.today/stolen-prehistoric-gold-bracelets-romania/">three prehistoric gold bracelets </a>(Bronze Age and early Hallstatt period, middle-end of the 2nd millennium BC) originating from archaeological sites on the territory of Romania.</p>



<p class="wp-block-paragraph">The bracelets were taken from the MAS Museum in Antwerp, Belgium. </p>



<p class="wp-block-paragraph">The three cultural assets of great value, protected by law, were stolen by unknown perpetrators and subsequently alienated. Two bracelets were identified when offered for sale at a public auction in the Principality of Monaco. The third bracelet was identified during the home search of the residence in Belgium of the person who submitted the two bracelets to the auction house in Monte Carlo with a view to public sale, the <a href="https://www.mpublic.ro/ro/content/c_20-02-2024-15-02">Romanian Public Ministry reports</a>.</p>

<p class="wp-block-paragraph">On October 27, 2020, the Belgian judicial authorities signalled the appearance of the two bracelets in an auction catalogue in Monte Carlo. On November 11, 2020, the criminal investigation officers in Romania notified ex officio regarding the commission of the crime of qualified theft.</p>



<p class="wp-block-paragraph">A criminal investigation was started, and later, the criminal investigation was extended to the crime of carrying out illegal export operations. </p>



<p class="wp-block-paragraph">The administered evidence showed that the three bracelets come from archaeological sites in northwestern Romania. Obtaining an export certificate, a document that does not exist, was necessary for their export.</p>



<p class="wp-block-paragraph">To make it possible to return the bracelets to Romania, it was necessary for the Flemish Regional Ministry &#8211; the Department of Culture to initiate a declassification procedure (the bracelets being protected by Flemish law as precious artifacts, being entered on a list of heritage assets).</p>



<p class="wp-block-paragraph">The action to return the bracelets was made possible by excellent judicial cooperation with the investigating judge from the Court of First Instance of Veurne &#8211; Belgium and benefited from the support of the Flemish Regional Ministry &#8211; Department for Culture, the Romanian Embassy in Brussels and the national member at Eurojust.</p>



<p class="wp-block-paragraph">The seizure was instituted on these assets, and they will be handed over to the custody of the National History Museum of Romania until the case is finally resolved, and they will be subjected to multidisciplinary expertise (physicochemical, museography, etc.).</p>

<p class="wp-block-paragraph">Romanian Anti-corruption Department DNA asks to waive the Parliamentary immunity of former Prime Minister Florin Cîțu. The crimes for which he would be investigated relate to the so-called COVID-19 pandemic and the acquisition of the so-called anti-COVID-19 vaccines.</p>



<p class="wp-block-paragraph">The prosecutors also asked for the waiver of immunity for the former health ministers Vlad &#8220;The Magician&#8221; Voiculescu and Ioana Mihaila. </p>



<p class="wp-block-paragraph">The reaction of the Socialists, now the ruling party, was quick and blunt. </p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>While the Romanians were dying, Voiculescu, Cîțu and Mihăilă STOLE! 1 billion euros was the cost paid by Romanians amid the pandemic for the millions of doses of useless vaccines bought by these criminals. Today, the DNA started the criminal investigation against this ORGANIZED CRIMINAL GROUP! The recidivist Cîțu and the &#8220;Magician&#8221; Voiculescu locked Romanians in their houses so they could STEAL! <p class="wp-block-paragraph">The anti-corruption prosecutors accuse the three former high-ranking officials of acquiring 52,805,690 unnecessary vaccine doses, totalling 1,005,498,687 euros, to which VAT is added, which damages the state budget. Initially, Romania acquired 37,588,366 doses, which would have been enough to vaccinate more than 23 million people, 4 million more than the country&#8217;s total population. </p>



<p class="wp-block-paragraph">Following this abuse, millions of doses expired and were destroyed or donated to third-world countries. </p>



<p class="wp-block-paragraph">Other European Union countries woke up regarding acquiring vaccine doses during the so-called pandemic, and the <a href="https://www.eppo.europa.eu/en">EPPO &#8211; European Public Prosecutor&#8217;s Office</a> started an investigation in that direction a year ago.  </p>



<p class="wp-block-paragraph">One thing is sure: when investigating the criminal deeds of any country&#8217;s official, prosecutors should investigate European officials as well. The contracts with the pharmaceutical giants were signed in Brussels, and the orders or suggestions to all the member states to acquire more vaccines came from the very top level of the European Commission. </p>



<p class="wp-block-paragraph">The same European institution didn&#8217;t allow the member states to negotiate the acquisition of vaccines or buy them separately from the producers. </p>

<p class="wp-block-paragraph">A Cyprus court ruled on Wednesday, October 11, to extradite billionaire Beny Steinmetz to Romania, where he has been sentenced to five years in prison for conspiring with the grandson of the former king and others to obtain former royal lands worth over US$100 million corruptly, <a href="https://www.occrp.org/en/daily/18123-cypriot-court-rules-to-extradite-mining-magnate-beny-steinmetz-to-romania">OCCRP reports</a>.</p>



<p class="wp-block-paragraph">Steinmetz’s representatives, however, said they would appeal the decision to the country’s Supreme Court. Judge Michalis Michael said Steinmetz would be detained until his extradition or the filing of an appeal, as there was a risk of his fleeing justice.</p>



<p class="wp-block-paragraph">Cypriot police arrested Steinmetz, 67, at Larnaca airport on August 31, based on a <a href="https://valahia.news/beny-steinmetz-arrested-in-cyprus-on-romanian-issued-warrant/">European Arrest Warrant issued by Romania</a> after his conviction for forming “an organized criminal group” Romania’s supreme court found him guilty in December 2020.</p>



<p class="wp-block-paragraph">As reported by the OCCRP, Steinmez’s legal team argued that his right to a fair trial in Romania had been violated due to the alleged illegal use of wiretap material and that one of the supreme court justices had never taken her oath of office. Steinmetz’s lawyers also accused the Romanian judges of anti-Semitism and argued that extradition would breach his human rights due to inhumane prison conditions in Romania. The businessman has denied the allegations of criminality in Romania.</p>



<p class="wp-block-paragraph">The Cypriot ruling comes as Steinmetz awaits the decision of Switzerland’s supreme court in a separate corruption case over some of the world’s most important mining rights.</p>

<p class="wp-block-paragraph">Israeli businessman Beny Steinmetz was arrested in Cyprus based on a warrant issued by Romania, where he had been convicted in absentia to five years in jail in a 2020 case for property fraud.</p>



<p class="wp-block-paragraph">Steinmetz was detained on Thursday &#8220;during his arrival at the Larnaca airport, due to a European Arrest Warrant (EAW) issued by the Romanian authorities, which has already been cancelled in various European countries, among them in Greece and Italy,” his spokesman confirmed, cited by <a href="https://www.haaretz.com/israel-news/2023-09-03/ty-article/.premium/israeli-billionaire-beny-steinmetz-arrested-in-cyprus-on-a-romanian-issued-warrant/0000018a-5b36-d252-abdf-5b7e42780000?v=1693752460994">Haaretz</a>.</p>



<p class="wp-block-paragraph">The arrest comes nearly three years after a Romanian court sentenced Steinmetz and political adviser Tal Silberstein in absentia to five years in jail each in an organized crime case. According to prosecutors, the two, together with a Romanian businessman and scion of the ex-Romanian royal family, sought to take assets out of the country fraudulently.</p>



<p class="wp-block-paragraph">Steinmetz was also detained in Greece and Italy, but both countries refused the extradition, fearing that he would not receive a fair trial in Romania.</p>



<p class="wp-block-paragraph">The spokesman for Steinmetz said the Interpol had cancelled its red notice, thereby rescinding the international arrest warrant issued by the Romanians, due to human rights violations, including a violation of Steinmetz’s fundamental right to a fair trial in Romania.</p>

<p class="wp-block-paragraph">Steinmetz was the wealthiest person in Israel, with a fortune once estimated by Bloomberg at USD 8 billion. Still, his fortune declined as his name appeared in Romania, Switzerland and other countries concerning corruption cases. </p>



<p class="wp-block-paragraph">Even so, whether the Israeli tycoon will be extradited to Romania is uncertain, as so far, multiple European and third-party countries have denied extradition following court decisions. </p>
